General Terms and Conditions (GTC)

1. Scope of application


1.1 Area of application

These General Terms and Conditions (hereinafter "GTCs") apply to all business relationships between Ristorante Pizzeria Waldparkstüble (hereinafter "Restaurant" or "we/us") and our customers (hereinafter "Customer" or "you"). The GTCs govern the rights and obligations of the contracting parties in connection with the use of the services and the purchase of products from the restaurant.
The GTCs apply to all orders for food and beverages, reservations and all other services offered by the restaurant. Changes or deviations from these GTCs require written confirmation from the restaurant.

1.2 Contractual partner
The contractual partners within the meaning of these GTCs are the restaurant and the customer. By using the restaurant's services or purchasing products, the customer agrees to the validity of these GTCs. The GTCs apply for the entire duration of the business relationship, beginning with the first contact between the customer and the restaurant.
The restaurant reserves the right to amend the GTCs unilaterally. Changes can be viewed by the customer via the publication on the website (www.waldparkstueble.de/en) and on the notice board in the restaurant and come into force unless the customer objects in writing within a reasonable period of time. In the event of an objection, the restaurant is entitled to terminate the business relationship.

2. Reservations


2.1 Reservation process
To make a table reservation, we ask our customers to contact our restaurant by telephone or in person. Online reservations can be made via our official website (https://www.waldparkstueble.de/en/reservierung). The reservation is only binding after confirmation by the restaurant. We reserve the right to refuse or change reservations, especially if they violate other existing reservations or operational concerns.

2.2 Cancellation conditions
The customer is entitled to cancel reservations free of charge up to 24 hours before the agreed date. In the event of cancellations at a later date, the restaurant reserves the right to charge a cancellation fee of at least € 15.00 per person (may vary due to special events such as New Year's Eve, wedding, birthday, Christmas party, etc.) of the agreed menu price or the minimum turnover. Cancellation must be confirmed in writing by the restaurant.

2.3 Reservation fees
For certain reservations, in particular for larger groups or special occasions, the restaurant may charge reservation fees. Such fees will be communicated to the customer in advance and must be paid before the reserved date. Reservation fees will be refunded if canceled in time according to section 2.2.

3. Menu and prices


3.1 Menu offer
The restaurant's menu offers a varied selection of Italian food and drinks. The restaurant reserves the right to change the menu at its discretion to reflect seasonal availability, quality standards or other operational requirements.

3.2 Pricing
The prices for food and drinks are clearly shown in the menu and to a reduced extent on our official website (https://www.waldparkstueble.de/en/menue). All prices are in euros and include VAT. The restaurant reserves the right to change prices without prior notice. For reservations already made, the prices quoted at the time of reservation apply.

3.3 Changes to the menu or prices
The restaurant may change the menu or prices at its own discretion. The customer will be informed of such changes before the order is finalized. In the case of orders or reservations already made, both parties reserve the right to make alternative arrangements by mutual agreement or to cancel the order.

4. Terms of payment


4.1 Accepted payment methods

The restaurant accepts the following payment methods: Cash, MasterCard, Visa, Visa Electron, Maestro, China UnionPay, JCB, girocard, Diners Club, V-Pay and NFC. Payment is made in the respective valid currency, the card reader works with dynamic currency conversion and is VAT-free (shop tax free). The restaurant reserves the right to refuse certain payment methods and may offer alternative payment methods at its own discretion.

4.2 Payment terms
Payment for products is due immediately upon receipt of the invoice or upon leaving the restaurant, unless otherwise agreed. For reservations for special occasions or events, different terms of payment may apply, which will be communicated to the customer in advance.

4.3 Tip
Tipping is not included in the invoice amount and is at the discretion of the customer. Tips are allocated directly to the service staff and support the quality of the service provided. The restaurant respects the customer's privacy regarding the amount of the tip and allows it to be paid in cash or by card.
If the customer wishes the tip to be shown on the bill, please contact the restaurant to receive a corrected bill with a declaration of the tip.

5. Allergens and additives


5.1 Allergens
Our dishes may contain allergens. Allergens are indicated directly behind the respective products on our menu. As a customer, you may inform our service staff of any allergies so that we can help you select suitable dishes. If allergens are not listed, please ask for our separate allergen information card.

5.2 Additives
Some of our dishes may contain additives. In our menu, the additives are indicated directly behind the respective products. We are at your disposal to answer any questions and help you choose dishes that meet your requirements. If additives are not listed, please ask for our separate list of additives.

6. Opening hours and operating times


6.1 Regular opening hours

The restaurant has the following regular opening hours:

Monday: closed
Tuesday to Sunday: 11:30 a.m. to 2:00 p.m. and 5:00 p.m. to 10:30 p.m.

These opening hours apply to normal restaurant operations. The restaurant reserves the right to change the regular opening hours at its own discretion. Such changes will be announced in good time on the website and in the restaurant.

6.2 Changes due to public holidays or special events
The restaurant reserves the right to change the opening hours on public holidays or during special events. Such changes will be announced in advance and published clearly visible on the website (https://www.waldparkstueble.de/en/angebote) and in the restaurant. For reservations or events affected by such changes, the restaurant will make alternative arrangements with the customer.

7. Hygiene and behavioral rules


7.1 Hygiene practices
The restaurant attaches great importance to the highest standards of hygiene. Customers are required to observe basic hygiene rules, especially in the area of hand hygiene and appropriate behavior in the sanitary facilities. The restaurant reserves the right to refuse entry to guests or ask them to leave the restaurant if they violate basic hygiene practices.

7.2 Dress code
Customers are requested to adhere to an appropriate dress code. The wearing of casual sportswear, swimwear, inappropriate outerwear or no (outer)clothing at all may be prohibited in the restaurant. The staff reserves the right to politely inform guests who violate the dress code or to refuse them entry.

7.3 Behavior in the restaurant
Customers are requested to behave respectfully towards staff and other guests. Disruptive behavior, harassment or indecent behavior will not be tolerated. The restaurant reserves the right to expel guests who violate the rules of conduct from the restaurant without entitlement to a refund.

8. Liability and warranty


8.1 Limitations of liability

The restaurant is only liable for damage caused by gross negligence or intent on the part of the restaurant or its staff. Any liability for slight negligence is excluded. The restaurant accepts no responsibility for loss or damage to customers' personal property in the restaurant or when using delivery services.

8.2 Guarantee for food and beverages
The restaurant guarantees the quality and freshness of the food and drinks. If products are defective, please inform the restaurant immediately so that an appropriate solution can be found. Warranty claims must be made within a reasonable period after receipt of the products.

10. Special offers and discounts


10.1 Conditions for special offers
The restaurant may offer special offers and promotions from time to time. Such offers are subject to certain conditions which should be carefully checked by the customer before taking advantage of them. The Restaurant reserves the right to change or withdraw special offers without prior notice. Offers cannot be accumulated or combined unless expressly stated otherwise.

10.2 Discounts
The restaurant may introduce discounts for regular customers. Customers cannot register for such programs; the restaurant reserves the right to select the program itself. Discounts are only valid in compliance with the specified conditions and cannot be applied to already discounted items or services. The restaurant reserves the right to change or discontinue discounts at its own discretion.

11. Final provisions


11.1 Severability clause
Should individual provisions of these GTCs be or become invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by a provision that comes closest to the economic purpose of the invalid or unenforceable provision.

11.2 Applicable law
These GTCs and all resulting legal relationships between the restaurant and the customer are subject to the law of the Federal Republic of Germany to the exclusion of the UN Convention on Contracts for the International Sale of Goods.

11.3 Place of jurisdiction
The exclusive place of jurisdiction for all disputes arising from or in connection with these GTCs is Hohenstadt, provided that the customer is a registered trader, a legal entity under public law or a special fund under public law or has no general place of jurisdiction in Germany.
